Terms and conditions

What you buy, what you pay, and what happens when an invoice stays unpaid or a service ends.

1. Who sells

Mail Exchange is a service of Pexys Sàrl, Quai du Rhône 8, 1205 Geneva, Switzerland (CHE-115.638.815). These terms apply to every order placed on mail-exchange.ch and to every service that follows from it.

2. What we sell

Mailboxes hosted on our servers in Switzerland, their options, the registration and renewal of domain names, and DNS zone management. Each plan and its price are listed on the Pricing page.

The service is intended for businesses and self-employed professionals.

3. Ordering and activation

Orders are placed online. An order is recorded when its invoice is created, and approved by us once payment is received. The mailboxes are then opened and their credentials are sent to you by email.

We may decline an order — unavailable domain name, plainly inaccurate information, use contrary to section 9. Any payment already received is then refunded in full.

4. Prices

Prices are stated in Swiss francs, excluding VAT. Swiss VAT, at the rate in force, is added for customers established in Switzerland and Liechtenstein.

A price change is announced by email at least thirty days before it applies, and applies only from your next renewal date.

5. Invoicing

The service is a subscription, monthly or yearly, payable in advance. The renewal invoice is sent to you before each renewal date; it is also available in your client area.

A domain name is billed yearly. Its renewal invoice is issued sixty days before expiry and payable thirty days before, leaving us time to renew it with the registry.

6. Payment

You pay each invoice by card (Visa, Mastercard) or by bank transfer.

Card payments are processed by Payrexx AG, a Swiss payment provider, with 3-D Secure authentication. We neither see nor store your card number. There is no automatic debit: each invoice is paid by you.

You can add funds to a credit from your client area. It is applied to your next invoices by itself. Unused credit is refunded on request when your account is closed.

7. Late payment

An unpaid invoice is followed by email reminders. Ten days after the due date, the service is paused: mailboxes no longer send or receive. Nothing is deleted. The service resumes as soon as the invoice is settled.

A domain name whose invoice stays unpaid is not renewed. It expires on its expiry date, and the addresses that depend on it stop receiving that day.

8. Cancellation and refunds

You may cancel at any time, without giving a reason, effective at the end of the current period. There is no commitment beyond the period paid for.

A period already started is not refunded pro rata, whether a month, a year, or a mailbox deleted during the period.

A domain name that has been registered, transferred or renewed is not refundable: it is acquired from the registry in your name, for the full year.

If the service is unavailable through our fault beyond what our availability commitment provides, the duration of the interruption is credited to you on request.

9. Use of the service

You agree not to use the service to send unsolicited mail, to distribute unlawful content, or in a way that compromises the platform for other customers. We may suspend an account that does so without notice, and we inform you at once.

10. Your data

Your messages, calendars and contacts belong to you. They are hosted in Switzerland, on our servers, under Swiss law — see Data sovereignty.

A deleted mailbox is kept for thirty days, during which it can be restored, then destroyed. When the service ends, you may request an export of your mailboxes before they are destroyed.

11. Liability

We use the means necessary to keep the service available and secure. Our liability is limited to the amount you paid for the service concerned over the last twelve months, except in case of gross negligence or wilful misconduct.

12. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is Geneva, subject to mandatory jurisdictions provided by law.

13. Contact

For any question about an invoice, a payment or a refund: contact@mail-exchange.ch.
